Canadian Mining Firm Sues Wynn Resorts Over $3.8M Casino Fraud

Canadian mining company James Bay Resources Ltd. and its CEO Steven Shefsky filed a lawsuit against Wynn Resorts Ltd., accusing the casino of negligence and unjust enrichment. The lawsuit concerns losses of $3.8 million caused by former track and field athlete and businessman David Bunewakz, using borrowed funds.

According to the lawsuit filed in Ontario court, Wynn Resorts failed to properly investigate the source of the funds, even though Bunewakz was under surveillance for fraud and had some civil lawsuits. James Bay Resources claims to have loaned Bunewakz $3.5 million, and another $1.1 million was loaned to Shefski personally.

Bunewakz, who has previous convictions for selling unlicensed securities and defrauding investors, continued to play at the casino, which the plaintiffs say proves Wynn's negligence.
